The Federal Court process is quite narrow in terms of what could be achieved. Compensation? no. Overturn decision? yes. Guarantee a future approval? Why would any Judge issue consent orders that override due process when the matter is before them on the grounds of bias/due process not being followed? It's a good theory for HC that deals were done behind the scenes but that just didn't happen IMO. What did happen is that Advent got an expedient outcome and the Government didn't waste millions defending a case that was unwinnable, the model litigant protocol.
