The fact she said 'departmental officials' (someone other than her) are "assessing" it, is likely to be not in due process. Because NOPTA are the ones that assess it. For it to be re-assessed by an unregulated entity is almost like double jeoparady. This could be a sign of disregarding due process. So if it does go back to court, this issue could be raised, (using her words against her). Semantically they could argue "assessment of which decision to make", but... that is not what the quote says, it says "applications with respect to PEP11 are currently under assessment". It's small, but sometimes small details tell us a lot.
