Yes but if a President breaks the law during the time he held office, once he leaves office, he can be criminally prosecuted. The only reason for 'immunity' is to provide continuity and confidence insofar as the Office of President is concerned. and not who the President happens to be. Why else would Nixon have needed a pardon?
