Ok, so Albos wording in that article makes it more clear now;

Scomo stuffed up the application rejection because he did it BEFORE the environmental approval. I.e. Albos take is that you have to use the environmental process to kill it to be 'safe' from overturning on bias grounds. And he has to be referring to a rejection because what threat is there for a court case overturning an approval due to bias when hes on the record as being against Pep11?

So, 1, what potential grounds are there for nopsema denying the application? They need to find some super rare hairy breasted bottle nose shark whose habitat is at the drill site. That takes time...

But more importantly, 2, Albo has telegraphed his strategy, clearly showing his continuing bias, which support why King (either for or against) hasn't approved after all this time, despite saying a long time approval process wouldn't be fair.
