That goes without saying, but do offers ever get made in biotech that are conditional upon a company receiving ODD for a product? That is, could a BP make an offer (and yes, that offer takes us then into a trading halt) that says "we will pay you $X for MPL, but only if you're successful with the ODD in June".
I can't imagine any legal reason why a potential buyer couldn't do so, but am asking if it is ever an occurrence in biotech? Is it something BP would consider doing, or will they ONLY wait until after a confirmed ODD?
