Well termination can get given with one months notice. If 4DS pull that trigger, it puts a need for urgency of decision on WD to at least purchase a license. They'll lose the right to refuse to counteroffer any takeover bid, but they'll still have access to the tech.
If the specs as determined in PL4 analysis are compelling enough for WD to use, then they would be crazy not at least to put some money down for a license. What's the upfront purchase cost on a technology license like this? A few million, if you're an early adopter? (Going on Renesas deal with BRN?)
