The most pertinent question is why the EPA said they have no issue but DIMERS has taken the contrary view. Something here is not passing the "pub test" and needs an independent review. Presumably and hopefully this will happen or should happen as part of the appeals process. Especially as applications for permitting by other parties in the past have been granted ( although not acted upon subsequently). Still, they were granted, thats the essential point here and I cannot imagine what has changed since in regards the native flora/fauna or potential land erosion issues other than activist groups applying pressure.
