I think the problem is that the company has yet to provide DERM with answers to questions regarding how they plan to manage the plant to avoid a repeat spill. I would have expected them to have anticipated this question when preparing the environmental evaluation. I am concerned that the response should be take so long. I called the company and was told that the response is due any day - just a matter of crossing ts etc. I imagine that they will want to leave no stone unturned to avoid possible further questions from DERM.
