Agree with you there regarding the door still being open for other parties. Non binding being the key word. What looked to me to be a disadvantage (and to most of the market today) looks now with some reflection to be a very shrewd tactical move.
PLV wouldn't agree to this if they couldn't meet the targets. Companies doing DD on PLV will either have to improve their original terms if still interested. JTC also have to keep looking over their shoulders so as not to be trumped.
Price has recovered slightly from day lows so maybe more people seeing this the same way
