The Supreme court is not hearing whether the mine can go ahead or not.
They are only looking at whether an appeal can be granted.
Their mandate it to apply the law for the case in front of them as it currently stands.
Not to wait and see if external events happen first.
The government will have to deal with the CRMA and how to apply it when its in front of them.
