This will catch him out if investigated, now there is a chance he calculated to just shy of 5% and others then pilled on. But again, all ASIC has to do is download the data and this is very very simple to figure out.
Brokers are not obligated to make sure a short seller has borrow. ALL they have to do is ask the client 'have you secured borrow'. if the answer is yes, go ahead. Hard to police with high vol, high mkt cap stocks but this one is super simple to piece together.
