EPBC returned my phone call this afternoon (Monday 1/11/10).
The caller could not advise me of the expected or an approximate approval date. The only guidance provided is that there is a statutory requirement for a decision to be given after 20 working days. The caller acknowledged that the clock had stopped, but did not (would not) give an indication as to the number of days the clock was stopped for.
The twenty business days has passed, so to use a clumbsy metophor, we are in extra time. Bearing in mind that, as I was told and now understand, there is a statutory requirement that a decision is to be made within 20 business days ( plus any clock stopping.) Assuming no substantive objections are made, I reckon the decision must be soon.
I must correct an assupmtion I made previously. I was advised today that the proponent of an application is advised of the decision first. This Federal Agency is then required to release the decision within 10 days of making the decision. I was advised that the decisions are usually released within a much shorter time frame. I was told to keep my eye on the website.
Realistically, we can only, at best, make an educated guess as to when, with any degree of precision, a decision will be made.
