PEP11 is very simple scenario

NOPTA recommended approval, that much can be concluded

Husic must give the most weight to the NOPTA advice when making his decision

Public interest alone is insufficient grounds to decline the application.

So, Husic has two choices, approve in line with the NOPTA recommendation, or decline and try to defend his decision in court. His problem is, there are no other grounds to decline the decision that can be legally defended IMO.

What do I predict? I predict that commonsense will prevail, and that Husic will begrudgingly grant approval. But I am prepared for it to go back to court too.

Like all other SH, I support any action that compels the JA to pay proper respect to the Federal Court decision, and gets the JA to act.
