The ATO could be lenient if you had mistakenly paid CGT on SOR profits, and then claimed a deduction to offset any losses trading SOR. However, if you correctly claimed the CGT exemption on SOR profits and then claimed a CGT loss trading SOR, I expect the ATO may throw the book at you. Its really not that hard to check by the ATO.
