I don't think there is a legitimate defence here. He said "imminent" multiple times and he also gave a journalist more context on the FDA discussion than he gave share holders via the ASX.
The theme here is that his word is unreliable. I'm not saying he has broken the law (I'm not a lawyer) but any idiot can see that he has strung share holders along and let us down - many many times.
