Whilst you can definitely argue validity via both legislative tools, my thinking would be that actions of this magnitude should be undertaken by the company rather than SH's or at the very least in conjunction with the company.

I guess this is the downside of DB being unable to divulge exactly what his legal course of action is or will be.

Its definitely a step up from what SH's having been engaged in writing letter, articles and lodging complaints, and does have the potential to derail what the company is involved in.

Having said that if SH's are finding legal options we should fully expect that DB's lawyers are across these alternatives and hopefully many more to get this out of its current stalemate.
