I keep on reading about past judgements re the Bengwenyama Minerals (PTY) LTD and others v Genorah case and come to the same conclusions.
1. Genorah appears to be in the right.
2. If the CC judgement goes against Genorah I can see Sth African Govt depts being sued for millions on the bases of funds spent on drilling Tubatse.
3. That the 5 leases will not be assigned to Bengwenyama Minerals ( who have contested only two) but most likely be available for Genorah to seek via application once again.
4. A contraversial judgement may create all sorts of problems for the government and may lead to many new court cases.
In my opinion ( not legally based nor influenced by my NKP holdings) I am anticipating that Bengwenyama Minerals (PTY) LTD may not succeed and the judgement will handed out early Dec. The past two court judgements took just on 3 months.
The above resolution may be the catalyst for a decision by NKP with whom it will execute a JV for both Garatau and Tubatse. Surely negotiations are underway with suitors using the Final BFS to quantify value and commitment?
Always hoping for an Xstrata ( or any other company)takeover at $2 plus.
Frustrating time just waiting and waiting for some action at corporate level and sp.
