How will the JA defend against this application??? Are they going to say - we need more than another 45 days? I dont see any defence that can be put up after sitting/delaying the decision for 9 months since the NOPTA report!
There are still 18 weeks left to the end of the year (Today to mid Dec). That is a total of approx 126 days. Deduct 45 days and u have 81 days left (ie 11.5 weeks)
So my question:
Can this application be heard and an order issued within the next say 11 weeks??
I dont see why not - as this is not a complicated application. Asset is not appealing a biased decision (like last time) - they are asking the court to ORDER the JA to MAKE a decision.
Now it makes sense why MMR is looking to relist before the end of this year.
SOoOo... IMO - a decision - whether it be court ordered OR the JA decides to do so without going to Court - will happen this year.
And yes -------- a decision is definitely IMMINENT.
