My sub judice question was legit insofar as whether it was said outside the court environment.
I know sub judice to be a tread lightly issue where the scales are not fixed between the discussion in the public interest and the fair trial of the protagonists unprejudiced by media commentary. I don't know if it applies to defamation proceedings in the WA, but considering the volatile nature of this case I would think opinions of those close to the action might come back to bite.
