I have had some experience in litigation and so I have a few thoughts as to how this might evolve. Litigations rarely go to court and are usually settled before. The courts in general put pressure on litigating parties to settle and good ethical lawyers (they are not all bad!) encourage the same. There will be horse trading going on between the parties behind the scenes. At this stage we don't really know too much about the plaintiff's claim. We do know, as a matter of public record, about the many errors and omissions that the directors have made. So the plaintiff clearly has some substance behind their case. For now Besra has the advantage in that it controls the narrative. That is why they made a veiled threat to counter sue. At first glance it's a clever way of deflecting the heat off Besra and on to the plaintiff. However, Besra would have to prove material damage in any such counter claim and the plaintiff, as far as we know, has not defamed Besra. All the plaintiff can do is list the wrongdoings of the company which are in the public domain. These concerns have been discussed in some depth on this message board over the last 6 months. If it does go to trial it will become a binary event for Besra and its other shareholders and the plaintiff. Also I suppose there is the possibility that more shareholders join the plaintiff and it becomes a broader class action. That would be very concerning for the rest of the shareholders, above all for Quantum. Personally I hope it gets settled soon as it's a further reason for people to not buy Besra shares. Though as other have said, it may be a positive step in building a desperately needed more credible management team.
