Having been twice sued for miss statements I don't think MSBs board will say the FDA says we have a validated potency assay - recklessly - because they would be sued. About 2 million US was the first instance, about 46.5 aussie the second instance - another would likely be greater or end the company and some careers.

Even if a BLA is received (say perhaps someone in the FDA overrules the likes of Klinker) I can't completely rule out some nuff nuff politician or careerist eventually getting a position at the FDA and doing the wrong thing (feeling the pain of the patient advocacy groups but not appreciating that there will be a lot more pain if dud impotent products are approved) - the science will still eventually have to come out.
