I don't think the court can ever say it must be approved. My understanding is the best the court can do is quash decisions that are quite obviously made outside of the law.
Therefore if that premise is correct (and other may correct me if I'm wrong) I think caretaker mode does play a part in the timing of all this. I would think Albo wants maximum benefit of the denial whilst knowing that he actually won't be responsible for the final decision. I think the delusion is in the fact that Albo thinks that denying PEP11 will save his political career.
Hmmm that seems to be a familiar narrative I wonder how that ended up for the last bloke who tried it.
