LEGAL MATTERS
Metals Australia shareholders were notified on Monday that the Namibian Supreme Court had formerly rejected attempts by a Namibian lawyer and his client to have a Supreme Court judgement reviewed or appealed.
The ?Notice of Irregularity? filed at the Supreme Court by Ephraim Kasuto, on behalf of his client Malaia Joses Amakutuwa, was formerly rejected by Deputy Registrar Loius Karsten in a letter dated December 17, 2010. Karsten informed Kasuto that the notice was dismissed due to the lawyer?s ?failure to refer to any legal basis for it to be considered as a pleading or proceeding in litigious proceedings?. Metals Australia chairman Sol Majteles told shareholders that the company is ?delighted that the registrar has now formerly rejected the attempt to challenge the Supreme Court?s final judgement. Our Senior Counsel has also confirmed that this now ends the attempt to frustrate implementation to the judgement?.
IMO, in its earlier articles , The Observer appeared to be a mouthpiece for Kasuto. This article appears to stick to the facts , and to exclude any futher comment from Kasuto ..arguably a clear indication that the Court has stamped its authority on the legal aspects of the matter . If he had any ammo left , I was expecting him to allude to futher games to be played ..but I think even he realises how close he is to contempt of Court action .
Now that the Court has finally delivered the knockout punch , I would be very surprised for MME obstruct the Court's clear and unequivocal direction that the EPL is the rightful property of MLS.
I look forward to that outcome being formalised quickly and the drills rolling on to the tenement.
