1. "Use patents" can be valuable, but they don't act a blocks from using knowledge to create your own inventions. For example, we couldn't prevent someone from using the cardioprotection MOA via a use patent on bisantrene from developing their own drug that targets the same MOA.
2. Use patent in general can be hard to enforce for drugs. For example, if you had a new use patent on a generic drug then it would be difficult to prevent doctors using the generic drug for your patented use "off-label". Use patents in the pharmaceutical industry are most useful in preventing a competitor promoting their version of a drug doctors for the patented use.
3. Yes it is possible that IP that could be patented by us could enter the public domain by discussion here. I can't think of anything that has done this, but this is one reason for us to hold back information. For example, a piece of data might not have IP importance directly, but if it leads to people here making the jump to some valuable idea and posting here then we would not be able to patent that IP. In an ideal world we would disclose nothing to our shareholders to prevent this risk, but I doubt many of you would want to be invested in a company that provides no updates as to our progress.
4. Yes there is always the risk that another company could decide to start developing their own bisantrene formulation, but it is unlikely. I know of no examples of anything like this happening. A good example is Abraxane which is a reformulation of the generic drug Taxol. Even though any pharma company could made their own reformulation of Taxol, nobody did until the patent on the Abraxane formulation expired and the generic companies moved in.
