My grasp of the English language is significantly better than yours. It is not pedantic. In a criminal case, the defendant can be found guilty. This is not a criminal case, hence no one will be found guilty.
You are now trying to pivot away from using the term "found guilty" and are simply using the word guilty in a sentence not related to the ICSID proceedings.
The distinction is important when analysing the situation. If Celestin, Lisette or some of the key Zijin employees ACTUALLY stood a reasonable chance of being found guilty of fraud or corruption related offences, then the situation would be very different. In that situation they may well behave differently as they act in their own self interest to avoid criminal penalties. However, if we don't ACCURATELY assess the situation and perspective of the stakeholders in this conflict, then any analysis or predictions of future behaviour or outcomes is simply worthless.
Are individuals at Zijin guilty of fraud and corruption offences? Absolutely. Are these individuals going to be "found guilty" by ICSID? No. Are they going to be "found guilty" by the courts in the DRC? Although it is hypothetically possible that they could be charged with criminal offences, I would say it is highly unlikely that they are found guilty in the short term. This is due to the level of corruption in the DRC legal system and the power China has amassed through corrupt payments.
