Nathan, your right about starting a fresh. No the DMR dont have to give preference to the Bengwenyama community that is the Bengwenyama minerals part of the community, the con court gave no such direction.

Both parties have submited 104 applications and it does not have to go to court to decided but I imagine the DMR will seek advice.

There has been numerous arguements from both sides as to whom should get the prospecting rights and only time will tell by the way of a DMR announcement.

My personal opinion has no bearing but I wouldnt be suprised if either side end up with one farm each, Bengwenyama with Nooitverwacht and Roka phasha with Eerste Geluk because lets face it meaningful consultation does not seem possible with these two tribes. The DMR will have given the impression of being fair to both parties and both will then have to work together to develope the farms without the DMR being piggy in the middle.
