Under a compulsory acquisition the number is greater than 90%. Considering this is all hypothetical and there are no terms in writing to lower the 90% target then one would have to assume a straight compulsory acquisition until stated otherwise.
Under a scheme of arrangement or special resolution as you have indicated the target for takeover amount could be lowered.
