Hey researcher - I cant find the pdf document on my computer to post the whole lot - but this is based on papers that Bengwenyama Royal Council lodged in the Highcourt and Supremecourt on the reason why they were supporting Genorah

The Chief has advisory councils - Normally a Tribal council(of regional elders) and Royal council. Royal council consists of members of each generation that fail to become chief because they are not the eldest or the 'chosen one'. But their system recognises their authority and so they are grouped into a Royal council(something like community elders) They are advisory to the chief. According to the Royal council in the case of the Bengwenyama community the Tribal council has been long defunct. Terry Nahon a lawyer had along with Zet Maphanga(who was neither a Royal council nor a Tribal Council member)made a scheme by which they would form a company with community ownership - but close to 40 - 50% shares would end up in their hands with the rest for community. The Royal council in their petition described Zet Maphanga as a 'Foxy' guy who was misdirecting the uneducated chief. The thought that Maphanga who was not a Royal council or Tribal council member was gathering himself a fortune quite disproportionate to what the rest of the community was getting was apparently the prime reason they looked at the Genorah alternative.

The situation has changed since: the chief is dead. The new chieftain isnt selected. The Royal council are now in a much more commanding position

We do know now that the communities hold 5% in Genorah
However I have also heard that in DMR filings Genorah has indicated that its direct 26% holdings in the farms are held in trust for the communities (considering that Genorah own 63% of Nkwes 64% share = so only about 40%) At each farm the communities direct 26% isnt bad and also possibly alleviates squabbles as to how much shares each community should be getting in genorah given that different of them - Roka and Beng are sitting on differing resource sizes)
