It's not a defence, it's a statement of fact. The FTC is a simple refund of tax that should not have been paid.
It's done this way because it's easier to administer the fuel excise charge on all purchases, then refund those to whom the charge is not applicable, than try to only charge the excise to those applicable at the point of purchase of the fuel.

I posted every other industry that the FTC is applicable to also. Basically all off-road uses of diesel etc. The mining companies are not being treated differently in this instance, they are being treated the same.
If you are calling for coal industry to lose the FTC, but for other industries to still be eligible for the FTC, it's you who are treating the coal industry differently. Is this what you are calling for?

To use your terminology, the coal industry is not being "subsidized" because it is the coal industry, it receives FTC's because it is an off-road user of diesel etc like countless other industries.
