It sounds to the normal person a conflict of interest, however, if it was a conflict of interest, then realteks lawyers could have argued that at court, put a motion in to remove, which they did not do, therefore i disagree legally that there is a conflict of interest on that point.
Commercial in confidence means he cannot disclose anything to do with anything - read what you typed, "anyone there or watching could not have come to the conclusion that there was no supply agreement ", but he didn't say that - this is a legal battle your going into, you have to be precise and look at it in the cold light of day. It is your conclusions that led you to believe there was one, he never said there was one.
This is the point, you need to look at everything from a legal perspective, on what you can or cannot prove, and you cannot prove that he ever said there was one, nor can you prove KPMG is a conflict of interest, because, as above, legally there was none. To do what you are trying to do needs solid substantial evidence, whilst its frustrating for everyone, unless you have anything better than the above, its not going to fly.
