I think you are missing the real motivations for NKP sending this letter through to the concourt. NKWE would have known the court would not budge, but it got some media attention and was a good platform to make it clear that the true land owners were not in fact those that represented themselves to be the land owners in court.

GOod move in my opinion from NKWE and should assist in the correct decison being made at the DMR as the information was placed out there for all to be aware of.
