Seems to me its hardly a constitutional right to be included in a restricted area with a restricted number of seats that someone needs to allocate. Plenty of conservative outlets weren't in the slec mix that the previous two Admins chose to allow in
Otherwise any and all could claim that they didn't get their seat was an infringement of their C right...which I guess makes sense to the lunatic left and yourself
