    This is what you posted about the lawyers.

    "We understand that Genorah and Nkwe had been "advised" that the prospects of the applicants succeeding with their appeal in the Constitutional Court had "little prospects of success" (not "no prospect) and that it was "unlikely" that the Constitutional Court would set aside the two judgments already obtained by Genorah in respect of the challenges to the granting of the prospecting rights."

    The first think I thought when I read this, is who advised Genorah and NKP that the appeal would not succeed.
    Their Lawyers? The same ones that did not think that who owned the land was material? Who thought that Advisers to Beng would be good enough for a 104. in the eyes of the court. The first two cases mostly revolved around Beng's appealing being after the 180 days.

    So who advised Genorah and NKP that they did not have to tell holders that they were court case.

    Did they know the first case would not succeed?(Didn't have to tell holder) The second? (Holders don't need to know)
    By the sounds of it, they knew the Con Court would not succeed.

    Most are in this mess because of one reason.

    The failure for NKP to disclose ANY of the court actions to holders.

    (ii) is information that a reasonable person would expect, if it were generally available, to have a material effect on
    the price or value of ED securities of the entity; the entity must notify the market operator of that information in accordance with those provisions.

    This should be everyone complain to ASX. It is undeniable that it had a material affect on the share price.
