KoBold Makes Offer for Congo Lithium as Country Courts US, page-1054

There are a few things to consider here from my point of view.

Kobold as a company based in the USA is in between. They are looking for promising projects and when looking at the DRC they also have to realize that it is a high risk country and even more so when we are talking about such amounts of investment and we consider the past in terms of corruption and interpretation of the mining code. Then there is the US government, which is already celebrating its progress with the Declaration of Principles as a huge success. Here I can well imagine that they have tried to accelerate the MoU between Kobold and AVZ to also motivate the DRC (and Rwanda) for the coming steps in the peace negotiations. Nothing is fixed as with the Declaration of Principles and much is still open. This US government has a high show character.The DRC government will also want to have a decisive say here. There is no other way to explain the granting of Mining License 15775 without any evidence in accordance with the Mining Code. Whatever Kobold is up to is happening in agreement with DRC, the US government and, in third place, AVZ.

This also raises the question: does Kobold already know exactly what they would be bidding on? And by that I don't mean the quality, but rather the quantity. What size of area can Kobold claim for itself when numerous legal issues are still being clarified? The DRC government has not yet made a binding statement on this and if so, is this in line with a potential decision at the ICC or ICSID? Decision at the ICC or ICSID? What exactly is AVZ actually selling to Kobold - what is their property?

A fair price is misleading for two reasons, but politically correct. The term reflects the uncertainty in the current situation and fair will also have to be considered from the bidder's point of view and he will tell you very clearly what is factually correct and not emotionally important.
