    It was my understanding that that gold mine was blocked using the powers under “section 10 of the Aboriginal and Torres Strait Islander Heritage Protection Act”.

    What commonwealth power would she use to compel or force a no decision. Do you also have anymore relevant cases of commonwealth blocking state epa or minster at approval stage?


    Separation of powers (section 51) seems to make me believe the ball is in the court of the state in this matter as I can’t see what relevant power they would use.
