I would hope they come up with some reasonable explanation as to why the control arm performed way better than expected in the conference call they can't just ignore it.
The fact that this is ongoing suggests to me they're looking for an explanation, it can't be all about if they owe money to the lenders I'm sure the legal agreement was cut and dry with no ambiguity considering the amount of cash involved. The lawyers would be able to tell them where they stand very quickly.
