Good question. According to the CEO at the Melbourne roadshow, EBR have filed about 100 patents covering many aspects of the technology. Notably, they continue to file new ones covering later innovations. So if some earlier patents have expired, they would have layered protections so that newer patents continue to cover their technology.
I recall the CEO commenting that if someone else were developing a left ventricle leadless CRT, he would have heard of it. No doubt they keep a close eye on filings.
