    PEDPA/PPSA: When we first proposed the agreement it was a single agreement which is common in industry but we were advised by the AG to separate the agreements in late 2019 into the PEDPA and PPSA – a bit cumbersome to administer but we had to take the advice of the AG. So we split the sections up and signed the PEDPA and then redrafted the PPSA into fiscal (Ministry of Finance) and processing and sale of product at surface (Min of Energy). When the independent review of the PPSA was completed by external lawyers at the end of last year it was very poorly done. They didn’t utilise local counsel to check what was compatible with the local law and so when we reviewed the draft it was shambles and we complained to the Africa Legal Service Fund who is paying counsel on behalf of Zim Govt that they had completely messed it up. It was then redone which took some time to undo the mess and following consultation with the various govt entities and the AG they came back to us and wanted it to be an amalgamated agreement. We had the same question as you are asking me – what has changed? So the AG’s office went away and a few weeks later they said that they had found a way to do it so it is still compatible with the law. We met with the President following the review their proposal and agreed to amalgamate into single agreement provided our existing rights in the PEDPA don’t get diluted. Those agreements have been amalgamated now and it will be a simpler agreement to administer and much easier to enforce.
