Interesting you compare this to ANZ (presumably Opes case) as the outcome in that was a cents in the dollar settlement by the bank.
In my mind, this would be the only reasonable outcome for loan holders and a possibility - particularly if the bank is found to be the lender (with GS acting as agent).
If this is the case then it should flush out any senior management issues at BEN as the stock will be a screaming short.
Remember how material this issue is to BEN's balance sheet.
