it was reported last year both in the press and at an Xstrata shareholder meeting that they were concerned about the various Genorah court cases. That is why they made no move after the BFS was produced. There was a reason for their stalling.
Don't forget that the first BFS was very favourable in financial terms.
Hopefully once ALL legal issues are resolved partners will be keen on a joint venture agreement. This time on NKP terms as the company has several options that can be pursued.
