I have emailed the company and the response I received was that they were still waiting for the ATO.

I've applied for a private ruling before from the ATO, yes they replied to me within 28 days, but the that was just a reply - the actual ruling didn't come untill awhile later.

I have to admit I'm getting a bit frustrated but have to stick to my original investment strategy. I am prepared to wait until the end of March at which point I will re contact the company. If I'm not happy with their response then I may consider giving the dividend a miss and offloading my position.
