Xstrata will do the JV if it makes financial sense to them. They already know about the legal claims and if they had any doubts, they certainly have had plenty of opportunity to pull out by now. But they haven't. Xstrata will act swiftly and decisively.
As for Miracle Upon Miracle (MUM) - I think their company name aptly sums up their predicament. The Beng faction that is with MUM have no chance now. They can launch whatever cases they want.
Based on my research and the research of others, it is clear the Roka Pasha are the owners of E. Just because you have filed a non-adjudicated land claim does not mean you are the owner (as the Beng faction claims).
Plus critically, the Beng are split and some support Genorah, some support MUM. No one knows which faction of the Beng is the real faction.
