I would see it as complete bull for EPN to be able to maneuver themselves into an advantageous position once a legal process has started.

Even normal people have a 12 month period prior to a divorce in which any funds "disposed of" is still counted. I mean you have 500k in the bank. Your wife files for divorce. That money even though it may "disappear" at the casino is still incorporated in any settlement. That's my understanding.
