Unfortunately there is a flaw with your suggestion. Shortly after the contract was terminated,NXS were suspended from trading for a few months, the accounts were qualified by the auditors who had significant concerns re: the going concern basis of relying on the accounts, the directors had a fiduciary duty / legal requirement to request suspension to source funding - in the end there was a share issue to keep the doors open. It would be pretty easy to show that NXS were unable to pay per the Trans contract terms. Again last year the trouble with LT requiring restructuring of notes and LT facility all demonstrates that NXS would not have been able to meet it's contractual obligations. But hey this is all history and many of us have dealt with this before, respectfully just taking issue with your view - unfortunately the past events continues today. A settlement as you suggest is a real possibility though??
