They have no information that is market sensitive requiring disclosure regarding NASDAQ.
When it is approved they have an obligation to disclose this.
Until then they don't.
It's like they don't have to give daily updates of how patients are going in trials, nor do they NASDAQ....till it is finalised.
The prosecution rests it's case.
