You say that another extension would bring these notes into play if they are voted into existence at the meeting.
In that case then the 75% clause would come into effect which states:
"the bidder and their associates have acquired at least 75 % (by number) of the securities that the bidder offered to acquire under the bid (whether the acquisitions happened under the bid or otherwise)."
That is, by then FML must have acquired at least 75% of the ordinary shares in existence at the time that made the bid.
