Imo Probably judging whether there is enough evidence and a point of law to back up the statement of claim to proceed to the next phase, ie is there a case to answer both legally and with the confidential information currently before the judge. Lets hope the evidence is conclusive and the based on it there is a case to answer.
I cant see the mediation not succeeding as even if the case goes to trial they will have to reach agreement re the NTA after that anyway.Split the costs and move forward?
Can the project proceed upon successful registration of the NTA post mediation with the M & D action in the background.
Hard to call that one.
