A couple of interesting points I think you are raising:

1) My take would be that if the Govt and DERM had an agenda, they would run various scenariois by their legals and they would be briefed on the pros, cons and risks of each ... I am guessing the recent Cougar action might have been given a near negligible weighting in any such risk assessment. Also, another poster this morning has shown regulators do not always get it right.

2) Are you implying that if the court does rule in favour of Cougar that Govt officials and regulators would continue the vendetta and be obstructive? That surely would be unwise?
