Only the company knows, but would be surprised if Alcoa didn't negotiate a get out clause somewhere along the way.
$100 million is a lot to give to a micro-cap (TSV&Latent) straight-up. Remember at the time, TSV was probably worth less the $20 million and shale was not on the radar.
