Native Title Mining Agreement
The litigation concerning the native title agreement for the Four Mile Project (NTMA) has been adjourned while the parties take steps to satisfy conditions precedent in accordance with a settlement between them. The conditions precedent to be satisfied include registration of a NTMA.
The terms of the settlement are otherwise confidential.

In relation to the Misleading and Deceptive Conduct charge….. The directions hearing adjourned on 12 May 2011 resumed on 31 Aug 2011. Judgement has been reserved. No date has been set for the next directions hearing.

Questions,
Is the M&D Conduct charge part of the conditions precedent in accordance with a settlement of the NTMA?
If the M&D Conduct charge is NOT part of the conditions precedent in accordance with a settlement of the NTMA, then when are we likely to get an update from the Judge on the next directions hearing.
We are getting very close to the 10 Feb 2012 and still no news on progress to the Deed of Settlement. Surely there is some progress to report?
Is the Board of Directors happy with the current NTMA settlement talks and confident of a complete and satisfactory conclusion?

Yes, I was at the AGM.
In response to your questions:
The M&D conduct is not part of the NTMA conditions precedent.
I will seek advice from our legal counsel on the next directions hearing concerning the M&D matter
The Board is satisfied that all parties are progressing the the NTMA discussions in good faith. However, it is not our intention to provide a running commentary on those discussions nor speculate on the outcome. That would be disrespectful to the Native Title holders.
